By using Stillward — whether the website, app, or waitlist — you agree to these Terms of Service ("Terms"). They are written in plain language because you deserve to understand what you are agreeing to. Please also read our Privacy Policy, which forms part of these Terms.
"Stillward", "we", "us", and "our" refer to the operator of the Stillward app and website (stillward.co.za). "You" and "your" refer to the person using Stillward. "Service" means the Stillward mobile app, website, waitlist, and any related features. "Content" means any text, insight, reflection, or other material made available through the Service. "AI-generated content" means Content produced automatically by artificial intelligence.
Stillward is a personal wellness tool that combines mood and stress tracking with AI-generated philosophical reflections drawn from traditions such as Stoicism, Buddhism, Taoism, and cognitive behavioural ideas. Its sole purpose is to support self-reflection, mindfulness, and personal awareness. Nothing in Stillward constitutes a professional service of any kind.

Stillward is not a medical device, diagnostic tool, therapy service, counselling service, psychology practice, psychiatry service, crisis intervention service, or any other form of clinical or professional mental health care.
The operator of Stillward is not a registered medical professional, psychologist, therapist, counsellor, social worker, or mental health practitioner of any kind. No part of Stillward — including AI-generated insights, philosophical reflections, or any other Content — should be interpreted as clinical advice, a clinical assessment, diagnosis, treatment, or a substitute for professional mental health care.
If you are experiencing a mental health emergency, suicidal thoughts, or a psychological crisis, please stop using the app and seek help immediately. Contact your local emergency services or a crisis helpline in your country. The app's crisis support screen lists free, confidential helplines for your country, and you can open it at any time. (For example, in South Africa you can call the SADAG Suicide Crisis Helpline on 0800 567 567 (free, 24 hours) or SMS 31393 for a call back.)
You must be at least 13 years old to use Stillward. If you are under 18, you confirm that you have the permission of a parent or legal guardian to use the Service and that a parent or guardian has agreed to these Terms on your behalf. Stillward is not intended for children under 13, and we do not knowingly permit their use of the Service. By using Stillward you confirm that you meet these requirements.
By using Stillward, you expressly acknowledge and accept that:
You can use parts of Stillward as a guest, or create an account. When you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account. Please provide accurate information and notify us immediately at hello@stillward.co.za if you believe your account has been compromised.

Stillward currently offers a free tier. A paid premium tier is planned but is not yet available, and no charge can be made until it launches. The features in each tier are described in the app and on our website and may change over time with reasonable notice. The terms below will apply to premium subscriptions once they become available.
Premium subscriptions are billed in advance on a recurring basis (monthly or yearly) through Google Play, and renew automatically until cancelled. You can cancel at any time through your Google Play account settings; cancellation stops future renewals but does not, by itself, refund the current billing period. Billing, cancellation, and refunds are governed by Google Play's policies and by any rights you have under applicable law.
All insights, reflections, and responses in Stillward are produced by artificial intelligence, generated automatically from the inputs you provide. No human reads or approves them before they reach you, and they do not represent the professional opinion of any qualified practitioner. Separately, the operator may review insights and follow-up conversations after delivery, together with the check-in inputs and follow-up questions that produced them, in order to monitor quality and safety. How that access works is set out in our Privacy Policy.
AI-generated content is not a substitute for medical, psychological, legal, financial, or any other professional advice. We make no guarantees about its accuracy, completeness, safety, or suitability for any purpose. You must not make important life, health, or emergency decisions based on it.
To provide the Service, we use trusted third-party providers — including a cloud/database provider and an AI provider — who process data on our behalf as described in our Privacy Policy. Their availability and behaviour are outside our control, and we are not responsible for their acts or omissions beyond our own reasonable diligence in selecting them.
Any notes or content you write in Stillward belong to you. We do not claim ownership of your personal data. You grant us a limited, non-exclusive licence to process your inputs only as needed to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the content you enter and confirm you have the right to submit it.
The Stillward name, logo, design, software, and the arrangement and presentation of the Service are owned by us or our licensors and are protected by law. These Terms do not grant you any right to use our branding or to copy, modify, or create derivative works from the Service, except as expressly permitted.
We handle personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy, which explains what we collect, how we use it, and your rights. By using Stillward you acknowledge that mood and stress check-ins, any notes you write, and any follow-up questions you ask about an insight may reveal information about your wellbeing, and you consent to our processing of that information for the purpose of providing the Service.
We aim to keep Stillward available but cannot guarantee uninterrupted or error-free service. We may take the Service offline for maintenance, updates, or reasons beyond our control, and we may update, modify, or discontinue features at any time. If we make significant changes that materially affect paying subscribers, we will give reasonable notice by email.
You may stop using Stillward at any time and may delete your account by contacting hello@stillward.co.za. We may suspend or terminate your access if you materially breach these Terms, use the Service unlawfully, or where necessary to protect the Service or other users. Provisions that by their nature should survive termination — including disclaimers, indemnification, and limitation of liability — will continue to apply.
To the maximum extent permitted by law, the Service and all Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or that the Service will be uninterrupted, accurate, or free of errors. Nothing in this section limits any warranty or right that cannot lawfully be excluded, including under the Consumer Protection Act, 2008 (see section 18).
To the extent permitted by law, you agree to indemnify and hold harmless Stillward and its operator from and against any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising out of or related to:
This indemnity does not apply to the extent a claim arises from our own fraud, gross negligence, or wilful misconduct, or from any liability that cannot lawfully be shifted to you.
To the maximum extent permitted by South African law, Stillward and its operator will not be liable for:
Where our liability cannot lawfully be excluded, our total aggregate liability to you for all claims under these Terms will not exceed the greater of (a) the total amount you paid us in the three (3) months before the event giving rise to the claim, or (b) ZAR 500.
Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our gross negligence, or for any other liability that cannot lawfully be excluded or limited under South African law, including the Consumer Protection Act, 2008.
If the Consumer Protection Act, 2008 applies to your use of Stillward, nothing in these Terms is intended to limit or exclude any right you have under that Act that cannot lawfully be limited or excluded. Where a provision of these Terms conflicts with such a right, that right prevails and the rest of these Terms continue to apply.
These Terms are governed by the laws of the Republic of South Africa. If you have a concern, please first contact us at hello@stillward.co.za so we can try to resolve it informally. If we cannot, any dispute will be subject to the jurisdiction of the South African courts. If you access Stillward from outside South Africa, you do so on your own initiative and are responsible for compliance with local laws.
We may update these Terms from time to time. The date at the top of this page reflects the most recent update, and significant changes will be communicated to registered users by email or in-app notice. Continued use of Stillward after an update constitutes acceptance of the revised Terms. If you do not agree, please stop using the Service.
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may assign ours to a successor of the Service. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
